Are cans draining THC potency from cannabis beverages?

The canna-beverage boom hasn’t happened yet, but with major beverage conglomerates betting big on infused drinks, Canadian consumers should expect to see the serious launch of a variety of THC- and CBD-infused soft drinks, juices, teas, and beer-and-wine clones begin soon and continue for the foreseeable future.

With multiple billion-dollar licensed parties about to launch beverage lines, the timing couldn’t be worse to discover the lining of aluminium cans may actually absorb the active cannabinoids in cannabis beverages, with the potential to reduce potency almost completely.

At issue in particular are cannabis beverages brewed using nanoemulsion technology, a widely promoted but sometimes controversial process of making cannabinoids both water soluble and faster-acting by breaking them down into smaller particles. Scientists theorize emulsified cannabinoid particles in a pressurized beverage can stick to the liner of commercial aluminium cans used to protect the can from rusting and the contents from taking on a metallic taste. The other reason the liner is in place, ironically, is to protect shelf-stability.

In the US, the product was first identified by brewer Lagunitas, who was brewing a line of cannabis beverages.

“The loss was horrible,” Harold Han told Yahoo Finance. The founder and Chief Science Officer of US nanoemulsion company Vertosa was present when Lagunitas tested its emulsions against its cans.

Tinley was another US cannabis beverage producer facing the same problem.

Their CEO Jeff Maser told Yahoo Finance, “When I say there is less cannabis, there is no cannabis left. It’s literally 97% absorption into the can after a few months. Guys are saying they solved that problem. Nobody really has.”

The extent to which licensed parties hoping to debut cannabinoid-infused beverage products in the coming weeks and months were aware of the problem with can liners is unclear—particularly since no canned or bottled cannabis beverages (or really any, other than infused tea bags) have yet entered the Canadian legal market.

Marketing materials for Hexo and Molson Coors’ joint beverage venture Truss show products in Tetra-Pac packaging, while Fluent Beverage Company, Tilray’s joint venture with Budweiser parent Anheuser-Busch InBev has revealed none of its proposed packaging. THC BioMed’s still-unreleased beverage THC Kiss appears marketed in plastic bottles.

Canopy, meanwhile, mysteriously delayed the launch of its line of beverages in mid-January, but initial marketing materials show several Canopy beverage products were planned to be released in cans. Canopy’s largest shareholder is Constellation Brands, whose many properties include Corona and Modelo beers, Svedka vodka, and Kim Crawford wines.

While LPs don’t want to fail on beverages, the presence of Fortune 500 beverage companies makes the game even more serious. All are looking to make up for declining beer sales whose slide cannabis legalization made have sped up, while in the case of Constellation, the company has invested $5-billion in Canopy and wants very much for its cannabis beverages to make a serious impact on the Canadian market. (In December, some analysts speculated Constellation would buy Canopy outright in part due to Canopy’s focus on making beverages central to its legalization 2.0 offerings.)

Beverages may face an uphill challenge, as in the US market they represent only a tiny shard of market share. Yet the US cannabis market has no comparable force to industry megaliths Constellation, Anheuser-Busch InBev, and Molson Coors.

Historically Florida has had a strong anti-marijuana stance — but recently the state has made some significant steps forward. Recreational marijuana remains illegal, but in 2016 voters approved a comprehensive medical marijuana program. Learn more about Florida marijuana laws below.

Recreational Marijuana in Florida

Florida has some of the harshest recreational marijuana laws in all of the United States. The possession of 20 grams or less of marijuana is charged as a misdemeanor with one year imprisonment and a fine of $1,000. Possession, use, or sale of anything greater than 20 grams is charged as a felony with prison time ranging from five years to 30 years and up to $200,000 in fines. Also, if you are convicted of a marijuana-related offense, the state of Florida can suspend your driver’s license for one year.

Mandatory Minimum Sentences for Marijuana

A mandatory minimum sentence is when a judge must sentence the defendant to at least the outlined mandatory minimum amount of jail time for violating a specified law. With other offenses, the judge is given some wiggle room to consider special circumstances, adjusting the defendant’s jail time to reflect the specifics of their individual case. However, with a mandatory minimum sentence, there is no ability to adjust the sentence based on the circumstances.

Many Florida marijuana laws include a mandatory minimum sentence for both possession and sale. For example, possession of between 25 and 2,000 lbs. of marijuana comes with a mandatory minimum sentence of three years, and possession of 2,000 to 10,000 lbs. of marijuana comes with a mandatory minimum sentence of seven years of jail time.

Is Hash Legal Under Florida Marijuana Laws?

Also known as hashish, hash is an extremely potent cannabis product that is made using the resin found on marijuana plants. Hash features high levels of THC, so possessing any amount in Florida is classified as a felony. Being caught in possession of hash can result in up to five years in jail and a $5,000 fine. Selling, delivering, or manufacturing hash is also a felony, and carries the same penalties as a possession.

Marijuana Concentrate in Florida

Marijuana concentrate is another highly potent form of cannabis, with all excess plant materials filtered out of the final product, leaving users with a very strong concentrate that only features cannabinoids like THC and CBD. Marijuana concentrates hold the exact same penalties as hash, with possession, sale, and/or delivery resulting in five years of jail time and a $5,000 fine.

Florida Marijuana Laws Regarding Drug Paraphernalia

“Marijuana paraphernalia” is any product used as an accessory for using marijuana, such as pipes and bongs. The possession of marijuana paraphernalia is a misdemeanor, with Florida marijuana law punishing those in possession of paraphernalia with up to one year of jail time and a $1,000 fine.

Local Decriminalization of Marijuana

Florida has several local jurisdictions that have passed local resolutions or laws that decriminalize the possession of marijuana or other cannabis products. For example, in Miami-Dade County, possessing up to 20 grams of marijuana only comes with a $100 fine.

Compare that penalty to the much more restrictive Florida marijuana law for the entire state, where the penalty for possession of up to 20 grams of marijuana is a misdemeanor that results in a $1,000 fine and up to a year of jail time. Medical Marijuana in Florida

Florida had a very restrictive high-CBD, low-THC marijuana law for a couple of years before 71% of voters approved Amendment 2 in November 2016 to allow full medical cannabis. Amendment 2 went into effect January 3, 2017, and the Florida Legislature passed legislation that implemented the amendment in July 2017.

Under Florida’s Right to Medical Marijuana Initiative, patients suffering from debilitating medical conditions are allowed medical use of marijuana provided they have a doctor’s recommendation and an identification card. Home cultivation for medical purposes is not permitted under the law. The law does allow qualifying patients to have a caregiver who is at least 21 years old to assist in the collection and administering of medical cannabis.

Originally, Florida marijuana laws permitted only medical cannabis oils, sprays, tinctures, edibles, and vaping materials. While smoking marijuana was originally not permitted under the law, in 2018 Leon County Circuit Judge Karen Gievers ruled that the constitutional amendment approved by Florida voters in 2016 broadly legalized medical marijuana and gave eligible patients the right to smoke marijuana in private. In March 2019, the Florida Legislature approved SB 182, a bill that overturns the ban on smokable forms of medical marijuana for adults and patients under 18 who are either diagnosed with a terminal illness or who have obtained a second recommendation from a pediatrician.

SB 182 also allows patients to order a 210-day supply of medical marijuana at a time, up from the original 70-day supply limit approved in the initial legislation.

Who Can Be Treated with Medical Marijuana Under Florida Marijuana Laws?

Florida’s medical marijuana program allows medical marijuana to be provided as treatment for patients with the following “debilitating medical conditions”:

  • Amyotrophic Lateral Sclerosis (ALS)
  • Cancer
  • Crohn’s disease
  • Epilepsy
  • Glaucoma
  • HIV/AIDS
  • Multiple sclerosis
  • Parkinson’s disease
  • Post-traumatic stress disorder (PTSD)
  • “Other debilitating medical conditions of the same kind or class as or comparable to those enumerated”

Additionally, in June 2019, Gov. Ron DeSantis signed into law HB 7107 to allow a cannabis-derived drug for children with epilepsy. The bill changes that specific drug’s classification in state law from a Schedule I substance to Schedule V.

Drugged Driving Laws in Florida

Drivers in Florida are forbidden from using their car or some other type of motor vehicle if there is any detectable level of THC and/or marijuana in their system. If you have recently consumed marijuana, even if it is legally obtained medical marijuana, do not operate a motor vehicle under any circumstances.

If found cultivating fewer than 25 plants, it is considered a third-degree felony punishable by incarceration up to five years and fines up to $5,000. If an individual is the owner of the property where more than 25 plants are being illegally cultivated, the offense is charged as a second-degree felony, punishable by 15 years in prison.

Florida’s Right to Medical Marijuana Initiative, signed into law by Gov. Rick Scott in March 2016, permits certain dispensing organizations to grow and distribute cannabis.

In June 2017, Gov. Scott signed the Industrial Hemp Pilot Projects Bill, which gives Florida A&M University and the University of Florida permission to conduct research pilot projects on growing and selling hemp. Nearly two years later, in May 2019, the Florida Legislature passed a bill enabling the commercial production of hemp. Florida had its hemp regulatory plan approved by the U.S. Department of Agriculture in April 2020.

CBD oil is a hot topic in beauty at the moment, and many brands have recently added CBD-infused products to their range.

However, until now, it’s not really made its way into the world of salon treatments. Which is why when we heard Hari’s Fulham Road salon had launched London’s first ever in-salon CBD hair treatment, we couldn’t wait to give it a go.

What is CBD oil?

CBD, also known as cannabidiol, is one of 104 chemical compounds found in the marijuana plant. Tetrahydrocannabinol (THC) is the main psychoactive substance found in cannabis but unlike THC, CBD is not psychoactive.

So what’s the deal? Is it legal?

Medicinal cannabis products (the definition of which encompasses any cannabis oil containing more than 0.2 per cent THC) are currently illegal in the UK. CBD oil, however – cannabis oil containing less than 0.2 per cent THC – has been legal in the UK for some time.

Holland and Barrett were the first UK retailer to stock a CBD oil back in January of this year, and since then, several low concentration versions of cannabis oil (and products containing cannabis oil) have hit the shelves of British pharmacies.

Why *might* it help your hair?

While the medical benefits of CBD are as yet unproven, many take it orally (for pain, anxiety, depression) and topically for conditions such as eczema and psoriasis.

It’s rich in the fatty acids omega 3 and omega 6 and also contains high doses of calcium, phosphorus, magnesium, potassium and vitamin E – all of which are great for the skin (and scalp).

It’s also understood to contain good levels of linoleic and gamma linoleic acid (GLA) – essential fatty acids which promote the maintenance of normal hair growth.

Hari, Founder of Hari’s hairdressers, is convinced of its benefits for hair. “CBD increases blood circulation therefore when used in our in-salon, Hari’s CBD Life Force Hair Treatment, it promotes hair growth and healthy hair production,” he says. “In addition, the CBD Oil balances sebum production so it’s great for both oily and dry or problem scalps helping to address a variety of hair and scalp complaints.”

So what happens in the treatment at Hari’s?

Hari’s have partnered with a specialist CBD oil brand called Spirit of Hemp to create a unique treatment. Spirit of Hemp’s products are unusual in that they contain a combination of pure, raw CBD oil combined with CBDA oil, which is essentially CBD before it’s heated and treated. CBDA is a more potent compound, so the logic is that you need less of it to feel the therapeutic effects.

The initial ritual

Once shown to my seat inside the beautifully botanical Hari’s salon on Fulham Road, I was offered the usual magazines and refreshments (it was post-6pm on a Friday, so mine was a gin and tonic) before being presented with a little pipette full of CBD oil (a third of the size of those we used in science class), which I was instructed to squeeze out under my tongue and hold there for 60 seconds. Full disclosure: ingesting CBD oil tastes faintly like licking a stoner’s carpet – best washed down with a gin chaser.

As a total novice in the marijuana department, I was intrigued (read, mildly concerned) to know what the pipette’s effects might be. Would I be chuckling my way through a head massage? Falling off my salon chair? However, my therapist assured me that (thanks largely to the lack of THC in the oil) any noticeable effects, which would take 15-20 minutes, would be very gentle. “You may feel particularly relaxed and revived,” she said “equally some people feel nothing.”

The Treatment

While the gulp of CBD oil worked its magic, the therapist set about applying the topical CBD mask to my hair. The treatment contains CBD and CBDA oils blended with coconut oil, Tamanu (a Polynesian nut oil) and other essential oils designed to deeply nourish the hair from the roots to the tips. It’s meant to help sensitive scalps, cleanse pores, balance sebum production and stimulate blood flow, encouraging healthy hair growth, lustre and shine.

While one therapist spent an intensely relaxing ten minutes massaging all that oily goodness into my scalp, neck and temples, another treated me to a wonderful hand massage (there’s a choice between optional hand and foot massage at this point), again using CBD oil.

While the distinctly weedy smell of the CBD means it wouldn’t be my massage oil of choice, the excellent double massage more than made up for it.

Tea and Infusion

Once it’s all massaged in, I sat under a heater for 20 minutes to ensure the mix penetrated to maximum effect. I was presented with a freshly brewed pot of Spirit of Hemp tea to enjoy whilst it developed. The Hemp Flower tea was brimming with CBDA and Flavonoids which I was told helps to reduce inflammation and offer protection from chronic and age-related diseases.

I wasn’t sure if it was the oil, the tea or (most likely) the gin and tonic, but there could be no doubt that by then I was feeling intensely relaxed.

Finishing Life Force Blow Dry

Finally, my hair was given an all-natural rinse to clean, cleanse and strengthen strands and smooth split ends. With glossy locks blow dried to perfection, I left the salon feeling all warm and fuzzy… and ready for another gin.

Cannabidiol (CBD)

Drug Information

Cannabidiol (CBD) is a phytocannabinoid derived from Cannabis species, which is devoid of psychoactive activity, with analgesic, anti-inflammatory activities. Unlike the main psychoactive cannabinoid in marijuana, tetrahydrocannabinol (THC), CBD does not produce euphoria or intoxication. CBD oil is primarily sold as artisanal product in the form of a tincture, concentrate, capsule, topical, spray, or vape oil.

There is currently one FDA-approved drug comprised of CBD. Epidiolex® is a pure, plant-based, pharmaceutical grade cannabidiol (CBD) extract that has proven effective in treating seizures among individuals two years and older with Dravet and Lennox-Gastaut Syndromes. It is consistent and free from contaminants.

Many alleged CBD products contain other cannabinoids, no cannabinoids, or no CBD. According to research published in JAMA, only 31% of CBD products purchased online contain the amount of CBD advertised on the label. There is no testing requirement to determine the levels of THC or other contaminants, such as mold or fungi. There is also no regulation on the extraction process, which may incorporate toxins such as butane.

In addition, manufacturers of CBD oil claim that their products contain innumerable health benefits such as preventing diabetes, eliminating pain, treating fibromyalgia, post-traumatic stress disorder, and insomnia among others. However, these claims are unsubstantiated as artisanal CBD products have not undergone the rigorous FDA-approval process that ensures that prescription drugs are reliable, pure, and that the benefits of the medication outweigh the risks for the intended population. Because of these unsupported claims, the FDA has sent several warning letters to firms that market unapproved new drugs.

Policy

With regard to CBD products in general, a 2015 Idaho Attorney General’s opinion states:

Idaho Code §37-2705(a) and (d)(19) and (27) define as schedule I controlled substances any “material, compound, mixture or preparation which contains any quantity’ of either marihuana” ((d)(19)) or “Tetrahydrocannabinols” (i.e., THC) ((d)(27)). Therefore, in order for an oil extracted from the cannabis plant to not be a controlled substance, two conditions must be met. First, the oil extract cannot contain “any quantity” of THC — not just less than .3%. Second, the oil extract cannot be deemed “marijuana” under Idaho Code §37-2701(t)…

In sum, unless an oil extract contains no THC and is excluded from the definition of “marijuana” under Idaho Code §37-2701 (t)…, such oil is a controlled substance in Idaho.

With regard to potentially THC-free CBD products, the 2015 Opinion states:

Assuming cannabidiol does not contain any THC (which is more than the undersigned knows), in order to not be deemed “marijuana” under Idaho Code §37-2701(t), it must be derived or produced from (a) mature stalks of the plant, (b) fiber produced from the stalks, (c) oil or cake made from the seeds or the achene of such plant, (d) any other compound, manufacture, salt, derivative, mixture, or preparation of the mature stalks, or (e) the sterilized seed of such plant which is incapable of germination.

In other words, the CBD must both contain zero THC and be derived from one of the five identified parts of the cannabis plant, otherwise it is illegal in Idaho under current law.

The 2018 Federal Farm Bill removes certain hemp-derived products with a THC concentration of no more than 0.3% by dry weight from Schedule I of the Controlled Substances Act, but it does not legalize cannabidiol (CBD) generally.

The Farm Bill ensures that any cannabinoid that is derived from hemp will be legal if and only if that hemp is produced in a manner consistent with the Farm Bill and associated state regulations. Idaho will need to enact legislation in response to the Federal Farm Bill.

Background

In 2015, CBD was brought to the center of Idaho’s legislative session. The bill, S1146a, promised legal relief for parents of children with uncontrolled epilepsy to obtain CBD oil with up to 0.3% THC from across state lines. In addition to ODP, Idaho State Police, Department of Health and Welfare (DHW), the Idaho Prosecuting Attorneys Association, the Fraternal Order of Police, the Idaho Police Chiefs Association, the Idaho Sheriff’s Association, and the Idaho Criminal Justice Commission opposed S1146a. Concerns about the bill included:

  • Lab testing
  • Law enforcement
  • Product purity
  • Product dosing and interactions

Despite these concerns, the Idaho legislature passed S1146a. Governor C.L. “Butch” Otter vetoed the measure and, instead, offered a solution by issuing an Executive Order for an Expanded Access Program (EAP). The EAP would provide children with intractable epilepsy access to pharmaceutical grade CBD, Epidiolex, as part of an FDA-approved study. Epidiolex was approved by the FDA in June 2018 and scheduled by the DEA in September 2018. It is now available for prescription and will be covered by most insurance.

Governor Brad Little issued an Executive Order on November 19, 2019 to resolve conflicts between state and federal law related to the interstate transportation of hemp—as defined in the 2018 Farm Bill—across Idaho. The executive order does not authorize or legalize the production of hemp, its byproducts, oils, or any other derivative prohibited by Idaho law. This Executive Order only permits the interstate transportation of hemp consistent with the 2018 Farm Bill and implementing regulations, the Executive Order, and the State of Idaho rules regarding the interstate transportation of hemp.
